The meeting was called to order at 7:30 p.m. by Chairperson Bill Holland.

Amy Brunges, 7750 Walnut, recommended an advisory committee for the ice arena and commented about her opposition to privatizing the concession stand and pro shop since there had been no discussions about it.

 

Bill Holland stated that there was no rush, but discussions had already been taking place for over a year and the Board had taken action to pursue the privatization of the pro shop and concession stand.  He said that the Board would make the decision before a contract was signed.

Minutes of a regular meeting of the Township Board of Georgetown Charter Township, Ottawa County, Michigan, held in the Township Hall, 1515 Baldwin Street, Jenison, Michigan 49429 on March 27, 2006, at 7:30 p. m., local time.

WHEREAS, Section 3 of Act 188 of the Public Acts of Michigan of 1954, as amended (the “Act”), provides that the Township Board may require petitions to be filed with the Township, signed by record owners of land constituting more than 50% of the total land area in the proposed special assessment district, before proceeding and exercising the power granted by the Act; and

WHEREAS, the Township Clerk has received petitions to undertake certain public improvements as described in Exhibit A attached hereto (the “Public Improvements”) and has verified that the petitions have been signed by the proper number of record owners of land; and

WHEREAS, there exists a need for the Public Improvements in the Township and the Act provides the means to finance the Public Improvements.

NOW, THEREFORE, BE IT HEREBY RESOLVED THAT:

1.     The Township Board intends to proceed on the petitions filed pursuant to the Act to make the Public Improvements as described in the Notice of Public Hearing, attached hereto as Exhibit A.

2.     The Township Board has authorized the preparation of plans showing the Public Improvements, their location and an estimate of the costs thereof.

3.     The plans and the estimate of costs have been filed with the Township Clerk.

4.     The Township Board hereby tentatively designates a special assessment district known as the Rushmore Lake Weed Control Special Assessment District, consisting of certain parcels of property described as set forth in the Notice of Public Hearing attached hereto as Exhibit A, which descriptions are incorporated herein by reference, and against which parcels all or a portion of the cost of said Public Improvements shall be assessed.

5.     The Township Board shall hold a public hearing on April 24, 2006, at 7:30 p. m. at the Township Hall located at 1515 Baldwin Street, Jenison, Michigan 49429 to hear and consider objections to the petitions, the proposed Public Improvements, the special assessment district tentatively desig­nated herein, and all other matters relating to said proposed Public Improvements.

6.     The Township Clerk shall cause to be published a Notice of the Public Hearing in the Advance Newspaper, a newspaper of general circulation within the Township, at least two (2) times prior to the public hearing, with the first publication at least ten (10) days prior to the public hearing.  Proofs of publication of such notice shall be filed with the Township Board.

7.     The Township Clerk, at least ten (10) days prior to the date of the public hearing, shall also send a Notice of the Public Hearing by first class mail addressed to each record owner, or party in interest, of each parcel of property to be assessed, at the address shown for such owner or party in interest upon the last township tax assessment records, as supplemented by any subsequent changes in the names or addresses of the owners or parties listed therein, except in the case of railroad companies, who shall be mailed a Notice of the Public Hearing by registered mail within five (5) days after the first publication of the notice described in Paragraph 6 above.

8.     The form of the Notice of the Public Hearing to be mailed and published, as required herein, shall be substantially as set forth in Exhibit A hereto.

9.     All resolutions or parts of resolutions in conflict herewith shall be and the same are hereby rescinded.

RUSHMORE LAKE WEED CONTROL SPECIAL ASSESSMENT DISTRICT

NOTICE IS HEREBY GIVEN that the Township Board of Georgetown Charter Township, Ottawa County, Michigan, will proceed to make certain public improvements (the “Public Improvements”) consisting of:

The annual eradication and/or control of aquatic weeds and plants, for engineering reviews, for testing water quality and for plant and aquatic species census on and in Rushmore Lake and related services.

#060327-10 - Ordinance Amendments-Sec. 20.4(H)

 

Moved by Stanley Sterk, seconded by Richard VanderKlok, to approve the following zoning ordinance amendment, Sec.20.4

 

            Sec. 20.4 (H)   Commercial soil removal.

            (1)        No soil, sand, gravel, or other earth material shall be removed from any land within the township without special land use approval, with the following exceptions:

                        a.         When the earth removal is incidental to an operation for which a building permit has been issued by the township;

                        b.         When the earth removal involves any normal landscaping, driveway installa­tion and repairs, or other minor projects;

                        c.         The earth removal involves less than 100 cubic yards;

                        d.         The earth removal is for the purpose of constructing a swimming pool;

                        e.         The earth removal will not be in violation of any other section of this ordinance, other Township ordinance, Soil Erosion and Sedimentation Control Act of 1972, or any other applicable state or federal law.

f.          A mineral mining license has been approved by the Mineral Mining

Board and the operation complies with the terms and provisions of

the mining license.

#060327-11 - Ordinance Amendments- Sec. 25.6(A) Portable Signs, Chapter 24 footnote (k), (m)

 

Moved by Stanley Sterk, seconded by Richard VanderKlok, to table the following zoning ordinance amendment to Sec. 25.6(A) Portable Signs and Chapter 24 footnote (k) and (m), as follows:

 

Sec. 25.6

            (A)       Residential Districts.  The following types of signs are permitted:

(6)        PORTABLE SIGN, one (1) portable sign per parcel, not exceeding thirty-two (32) square

feet in area per sign and set back at least ten (10) feet from the road right-of-way line or distance as required in Chapter 24(b) (revised 1-24-05).  No electrical cord attached to the sign shall extend more than six (6) feet from the power source to the sign.  Such sign shall not be displayed for more than seven (7) consecutive days and shall not be permitted more than six (6) such display periods during the calendar year.  A separate permit and fee shall be required for each display period and the permit sticker shall be affixed to the sign for the entire display period.

 

(6)        PORTABLE SIGN, subject to the following restrictions:

The sign shall be set back at least ten (10) feet from the road right-of-way line or from the distance as required in Chapter 24(b).  No electrical cord attached to the sign shall extend more than six (6) feet from the power source to the sign.  A display period consists of a maximum of seven (7) consecutive days.  A separate permit and fee shall be required for each display period and the permit sticker shall be affixed to the sign for the entire display period.

 

a.         Per parcel (unless a business center)

1.      One (1) portable sign displayed at a time not exceeding thirty-two (32) square feet in area per sign;

2.      Such sign shall not be permitted more than four (4) such display periods during the calendar year; 

3.      If all display periods for a calendar year have been used and evidence is submitted to the Township that a new business has commenced on that parcel, one (1) additional display period shall be permitted in that calendar year;

4.      The additional sign shall be permitted only during the calendar year in which the business change takes place and must be taken out by the new business only.  

 

b.         Per business center

1.      One (1) portable sign displayed at a time not exceeding thirty-two (32) square feet in area per sign;

2.      Each business center unit shall not be permitted more than a maximum of one (1) such display period per calendar year;

3.      If all display periods for a calendar year have been used and evidence is submitted to the Township that a new business has commenced in a unit of a business center, one (1) additional display period shall be permitted in that calendar year for that unit in a business center. 

4.      The additional sign shall be permitted only during the calendar year in which the business change takes place and must be taken out by the new business only.  

 

            Chapter 24

                        (k)       Except for necessary drives and walks the required front yard for a depth of thirty          (30) feet shall be landscaped and shall not be used for parking, loading, or accessory       structures.  Required off-street loading areas shall not be provided in the front yard.

            (m)       Where a side and/or rear yard abuts a Residential District, there shall be a minimum yard of not less than twenty five (25) feet, exclusive of parking and drives.  Such yard shall contain a greenbelt which meets the mini­mum standards of Sec. 3.11.  Fur­thermore, no commercial or industri­al building and/or parking lot shall be located closer than fifty (50) feet to any Residential District boundary, (except when the residential district is HDR, in which case parking need only be a minimum of 25 feet from the boundary exclusive of parking and drives).

Moved by R. J. Poel, seconded by Richard VanderKlok, to approve the following resolution to receive an application for an Industrial Facilities Exemption Certificate and to tentatively schedule a public hearing for April 24, 2006:

 

“RECEIVING ACTIVE MACHINE AND TOOL COMPANY INC.

CERTIFICATE APPLICATION (ACT 198)”

 

            Whereas, Active Machine and Tool Company Inc. has submitted an application for an   Industrial Facilities Exemption Certificate; and

 

            Whereas, the Township Board of Georgetown Township must approve or disapprove said        application in accordance to Act 198 of 1974; and

 

Whereas, section 5 of Act 198 of 1974 requires the hearing of opinion from the applicant, the assessor and the affected taxing units.

 

            BE IT RESOLVED, that a hearing be held April 24, 2006 to hear public opinion concerning      said application.
