RESOLUTION NO. 3;

FILING OF SPECIAL ASSESSMENT ROLL;

NOTICE OF PUBLIC HEARING

Minutes of a regular meeting of the Township Board of Georgetown Charter Township, Ottawa County, Michigan, held in the Township Hall, 1515 Baldwin St., Jenison, MI 49429 on April 24, 2006, at 7:30 p.m., or after, local time.

PRESENT:   Members William Holland, Daniel Carlton, R. J. Poel, Del South, Stanley Sterk, Dale Mohr

ABSENT:     Members

The following resolution was offered by Member R. J. Poel and supported by Member Daniel Carlton:

WHEREAS, the Township Board, pursuant to Act 188 of the Public Acts of Michigan of 1954, as amended (the “Act”), has resolved its intent to make the public improvements described in Exhibit A hereto (the “Public Improvements”); and,

WHEREAS, the Township Supervisor has prepared, certified and reported to this Township Board a special assessment roll for the parcels of property benefited by certain Public Improvements and located in the Rushmore Lake Weed Control Special Assessment District.

NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

1.     That the special assessment roll for Rushmore Lake Weed Control Special Assessment District (the “special assessment roll”), as reported to the Township Board by the Township Supervisor, shall be filed in the office of the Township Clerk and shall be available for public inspection during the normal working hours of the Township office.

2.     That the Township Board shall hold a public hearing on May 22, 2006, at 7:30 p.m., or after, at the Township Hall in the Township to review and hear any objections to the special assessment roll.

3.     That the Township Clerk shall cause to be published a notice of hearing and of the filing of the special assessment roll, in the Grand Valley Advance, a newspaper of general circulation within the Township, at least two (2) times prior to the public hearing, with the first publication at least ten (10) days prior to the public hearing.  Proofs of publication of such notice shall be filed with the Township Clerk.

4.     That the Township Clerk, at least ten (10) days prior to the date of the public hearing, shall send a notice of the public hearing, by first class mail addressed to each record owner of or party in interest of each parcel of property to be assessed, at the address shown for such owner or party in interest upon the last Township tax assessment records, as supplemented by any subsequent changes in the names or addresses of the owners or parties listed therein, except in the case of railroad companies, who shall be mailed a notice of the hearing by registered mail within five (5) days after the first publication of the notice in Paragraph 3, above.

5.     That the notice of the hearing to be mailed and published pursuant hereto shall be substantially in the form set forth in Exhibit B hereto.

6.     That all actions heretofore taken by Township officials, employees, and agents with respect to the Improvements and proceedings under Act 188 are hereby ratified and confirmed.

7.     The assessments in said Georgetown Township Special Assessment Roll for Rushmore Lake shall be due on or before June 1, 2006, payable 30 days without interest, and the unpaid delinquent assessments charged 1% per month from June 1 and 6% beginning September 1 and placed on the tax roll.

8.     That all resolutions or parts of resolutions in conflict herewith shall be and the same are hereby rescinded.

NOTICE IS FURTHER GIVEN that the Township Supervisor of Georgetown Charter Township has made and certified a special assessment roll for the Rushmore Lake Weed Control Special Assessment District which roll sets forth the relative portion of the cost of the said Improvements which is to be levied in the form of special assessments against each bene­fitted lot and parcel of land in the special assessment district.

HEARING

TAKE NOTICE that the Township Board of Georgetown Charter Township will hold a public hearing on May 22, 2006, at 7:30 p.m. at the Township Hall located at 1515 Baldwin St., Jenison, MI 49429 to review the special assessment roll and to hear and consider any objections thereto.

TAKE NOTICE that appearance and protest at the public hearing is required in order to appeal the amount of the special assessment to the state tax tribunal.

TAKE NOTICE that an owner or party in interest, or his or her agent, may appear in person at the hearing to protest the special assessment, or may file his or her appearance or protest by letter, on or before the close of the hearing. 

TAKE NOTICE that any person objecting to the assessment roll is requested to file written objections thereto with the Township Clerk before the close of said hearing, or within such further time as the Township Board may grant.

TAKE NOTICE that an owner or any person having an interest in the real property may file a written appeal of the special assessment with the State tax tribunal within thirty (30) days after the confirmation of the special assessment roll, if the owner or person having an interest in the real property protested the special assessment at the hearing held for the purpose of confirming the roll.

TAKE FURTHER NOTICE that the special assessment roll as pre­pared has been reported to the Township Board and is on file with the Township Clerk for public examination.

This notice was authorized by the Georgetown Charter Township Board.
