RESOLUTION NO. 2; DETERMINATION TO MAKE PUBLIC IMPROVEMENTS; DETERMINATION OF SUFFICIENCY OF PETITIONS; APPROVAL OF PLANS AND ESTIMATE OF COST; FINAL DETERMINATION OF SPECIAL ASSESSMENT DISTRICT; PREPARATION OF THE SPECIAL ASSESSMENT ROLL

Minutes of a regular meeting of the Township Board of Georgetown Charter Township, Ottawa County, Michigan, held in the Township Hall, 1515 Baldwin Street, Jenison, Michigan 49429 on April 24, 2006, at 7:30 p.m., or later, local time.

PRESENT:   Members William Holland, Daniel Carlton, R. J. Poel, Del South, Stanley Sterk, Dale Mohr

ABSENT:     Members Richard VanderKlok

The following resolution was offered by Member R. J. Poel and supported by Member Del South:

WHEREAS, the Township Board, pursuant to Act 188 of the Public Acts of Michigan of 1954, as amended (the “Act”), and after receipt of a petition signed by record owners of lands constituting more than fifty percent (50%) of the total land area in a proposed special assessment district, has resolved its intention to proceed to make certain public improvements in the Township as identified on Exhibit A attached hereto (the “Public Improvements”); and

WHEREAS, public notice was given, pursuant to the Act, by publication on April 4, 2006 and April 11, 2006 and by first class mail on March 29, 2006, of a public hearing held on April 24, 2006; and

WHEREAS, at the public hearing the Township Board heard and considered all objections to the petitions for the creation of a special assessment district, to the proposed Public Improvements, to the special assessment district which has been tentatively designated, and to all other matters relating to the Public Improvements.

NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

1.     The Petition for Creation of Special Assessment District for the annual eradication and/or control of aquatic weeds and plants, for engineering reviews, for testing water quality, and for plan and aquatic species census on and in Sunnyview Lake and related services is hereby found to be a good and sufficient petition signed by more than fifty percent (50%) of record owners of the land area of the proposed special assessment district that will benefit by the proposed control of aquatic weeds and plants in accordance with the Act.

2.     That the Township Board hereby determines that it is necessary and in the best interest of the Township to make the Public Improvements described on Exhibit A.

3.     That the special assessment district known as “Sunnyview Lake Weed Control Special Assessment District 2006” is hereby finally determined to consist of the parcels of land tentatively designated by resolution of March 27, 2006, and shall exist for a term of not to exceed fifteen (15) years, with an option to continue the term for an additional fifteen (15) years.

4.     That the plans for the Public Improvements (which are on file at the Township offices) and the estimate of costs as shown on Exhibit A for each year of the Special Assessment District are hereby approved.  Each year during which the special assessment district is in effect, the Township Board shall have the discretion to utilize an engineer for the Township to perform work regarding the district and to add the costs and expenses thereof to the district.  Also, the Township Board may require periodic bids from various aquatic weed and plant treatment/eradication firms before deciding for a given year which company or firm to utilize for district services for a given year.

5.     That the total amount of the cost of the Public Improvements for each year of the Special Assessment District shall be paid by special assessments assessed within the special assessment district against the properties benefited by the proposed Public Improvements.  Assessments shall be made on a per property basis.

6.     That the Township Supervisor is hereby directed to prepare a special assessment roll upon which shall be entered and described (i) all the parcels of land to be assessed, (ii) the names of the respective owners thereof, if known, and (iii) the total amount to be assessed against each parcel of land for the first year of the special assessment, which amount shall be the relative portion of the whole sum to be levied against all parcels of land in the special assessment district as the benefit to the parcel of land bears to the total benefit to all parcels of land in the special assessment district.  The Township Board shall thereafter annually determine the amount to be assessed in the district for the Public Improvements, without prior notice to record owners or parties in interest in the property comprising the Special Assessment District.  The Township shall not add property to the Special Assessment District and may not increase the original estimate of cost by ten percent (10%) or more without further notice and public hearing.

7.     That when the Township Supervisor has completed the assessment roll substantially in the form of Exhibit B attached hereto, he shall certify that the roll was made pursuant to resolution of this Township Board and that in making the assessment roll he, according to his best judgment, conformed in all respects to the directions contained in such resolution and the statutes of the State of Michigan.

8.     That the special assessment roll, as made and certified by the Township Supervisor, shall be reported to the Township Board and shall be filed in the office of the Township Clerk.

9.     All actions heretofore taken by Township officials, employees and agents with respect to the improvements and proceedings under Act 188 are hereby ratified and confirmed.

10.            That all resolutions or parts of resolutions in conflict herewith shall be and the same are hereby rescinded.
